Man In Legal Trouble For Growing Too Much Medical Marijuana
James E. Smith, a 71-year old from Bay County, Michigan is facing a felony charge for purportedly growing way more medical marijuana than is legally allowed by the state. Smith, who does have a medical marijuana card but is not registered as a ‘caregiver,’ was found in possession of 30 plants during the investigation despite the limit for those listed as caregivers being 12 plants per individual patient. The plants and other related paraphernalia were found via a search warrant executed back on October 30th. The warrant was issued as a result of an investigation that began when Smith’s former roommate turned to the authorities due to an argument that they had where he had threatened her physically. Smith can ultimately face up to seven years in prison and a $500,000 fine if found guilty of the charges.

The Bay Area Narcotics Enforcement Team (or BAYANET) on Oct. 30 executed a search warrant on the home of James E. Smith at 4226 S. Carter Road in Williams Township. Divided among two grow rooms and a shed, they found and seized 30 plants, 17 clones, three electric ballasts, and two cellphones, court records show.
According to the state’s Medical Marihuana Act, patients can have 2.5 ounces of usable marijuana. Caregivers can grow up to 12 plants producing 2.5 ounces of usable marijuana for each of their five patients and themselves. If a caregiver is a patient and has five registered patients, he or she can grow 72 plants.
Authorities issued a warrant for Smith on Feb. 7. The following week, he was arraigned on one count of delivering or manufacturing 5 to 45 kilograms of or 20 to 200 marijuana plants or a synthetic equivalent. The charge is punishable by up to seven years in prison and $500,000 fine.
