A mother charged for treating her daughter’s anxiety with weed has learned that sometimes, making a medical decision for your child can land you in jail. Her daughter’s principal found edibles in her possession while she was at school and called Child Protective Services. The mother was later forced to admit that she gave her daughter edibles.
Mom Gives Daughter Weed Candy
Sylvia A. Rubio, 38, was arrested on Tuesday for child abuse, contributing to the delinquency of a minor and distribution of marijuana to a minor, according to the Doña Ana County Detention Center in Las Cruces where she is being held.
It all started in November when Rubio’s daughter turned up in a criminal complaint. According to the Las Cruces Sun-News, the complaint claimed Rubio’s daughter allegedly took both marijuana and chocolates infused with THC to school. This led to the principal referring the matter to Child Protective Services.
Detectives questioned Rubio about her daughter’s possession and she told them that she has a medical marijuana card and a personal production license. She also claimed that after talking to a homeopathic doctor about her daughter’s anxiety, he recommended giving her daughter weed candy.
Rubio confessed to giving her daughter gummies with THC in them but denied giving her daughter the chocolates. She says the bathroom cabinet where she kept them was left unlocked. A drug test confirmed the presence of THC in the 13-year-old girl’s system.
Even if there wasn’t THC in her system, section five of the New Mexico Medical Marijuana Law prohibits even registered patients from bringing medical marijuana on school property. The law also states that if a licensed producer sells, distributes, dispenses or transfers cannabis to a person not approved by the department pursuant to the Lynn and Erin Compassionate Use Act is in violation of federal law and subject to arrest.
Rubio is being held without bond in the Doña Ana County Detention Center, pending arraignment.
THC For Anxiety
THC is capable of both calming and exacerbating anxiety. However, it is also the main psychoactive component of cannabis and illegal to give to minors without a doctor’s recommendation.
We don’t know exactly how much THC was in the edibles Rubio gave to her daughter but if it was your typical edible, it likely contained mostly THC and few non-psychoactive cannabinoids that can also benefit anxiety.
New Mexico law allows minors to register with caregivers to legally get medical marijuana. Had Rubio registered her daughter, her charges would have been far less severe. For someone with anxiety, high CBD products are better for treating the symptoms without exacerbating the paranoia that can come with marijuana use.
